1. GENERAL PROVISIONS1.1. The text of this Offer is an official public offer addressed to individuals to conclude a Service Agreement in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan. The Service Agreement is considered concluded and takes effect when an individual performs actions as outlined in this Offer, signifying their full and unconditional acceptance of all the terms of this Offer without any exceptions or limitations under the conditions of accession.
1.2. Individual Entrepreneur Dream Way, as the organizer of the cultural and sports event "BLAZE FEST" (hereinafter referred to as the "Organizer"), offers Internet users (hereinafter referred to as the "Participant") to use the "BLAZE" website, available at
https://dreamway.kz/blaze (hereinafter referred to as the "Site"), to make payments for participation in the cultural and sports event "BLAZE FEST" organized by the Organizer.
1.3. The Site provides the Participant access to information about the cultural and sports event "BLAZE FEST," including information about its venues and dates, texts, illustrations, photos, graphics, audio and video materials, and other information about cultural and entertainment events (hereinafter referred to as "Materials"), as well as the cost of participation and attending as a spectator, provided by the Organizers.
1.4. The price information for participation published on the Organizer's Site before purchase is not an offer, and the current price must be clarified according to the rates available on the date of actual ticket purchase on the Organizer’s Site.
1.5. The terms of the Offer may be modified by the Organizer without any special notification. The new version of the Offer takes effect from the moment it is posted on the Internet at
https://dreamway.kz/blaze, unless otherwise specified in the new version of the Offer.
1.6. If the Organizer makes any changes to this Offer according to clause 1.5 of these Terms, with which the Purchaser disagrees, they should stop using the Site.
2. OBJECT OF THE AGREEMENT2.1. Under the terms of this Offer, the Organizer grants the Website User the opportunity to participate in the cultural and sports event "BLAZE FEST" by making a payment through the Organizer’s Site.
3. PAYMENT CONDITIONS FOR PARTICIPATION VIA THE SITE3.1. By using the Site, the User agrees to the terms of the Offer as outlined therein.
3.2. By registering for participation, the user confirms that: i) they have fully familiarized themselves with the terms of the event and this Offer, ii) they understand and accept the terms of the Offer, iii) they understand the meaning and consequences of their actions upon accepting the terms of the Offer.
3.3. The User enters into a direct contractual relationship with the Organizer when making a payment for participation. The Organizer assumes obligations related to the organization and execution of the Event, the right to attend which is confirmed by the Payment Receipt.
3.4. Participation is confirmed after payment and after the User receives a notification in the form of an electronic receipt or invoice by email, as well as a message from the BLAZE FEST Manager via WhatsApp to the number provided during payment.
3.5. If the User does not receive a Receipt/Invoice and Message from the BLAZE FEST Manager within 5 (five) hours after payment, they should contact the Organizer’s customer support service to clarify the status of their registration.
3.6. The Organizer confirms that the service authorized to securely accept funds from Users for payment of participation in the BLAZE FEST event is the online platform TipTop Pay. All rights and obligations arising from User participation registration belong directly to the Organizer.
3.7. The User of the Site confirms their consent that personal information provided to the Organizer during registration may be transmitted to third parties for storage and/or processing purposes, with whom the Organizer has contractual relationships solely for these purposes. The User agrees that the Organizer may store the information provided during registration for at least three years from the date of execution of the corresponding Agreement by the Organizer.
3.8. By paying for participation, the User agrees to receive (i) emails from the Organizer after purchase confirmation, in case of event cancellation, and (ii) messages, including voice messages (SMS, WhatsApp, other messengers) to the phone number/messenger provided by the User.
3.9. The Participant hereby confirms that the information provided about themselves and their colleagues during registration on the Organizer’s Site is truthful, current, and guarantees the possibility of contacting them by the Organizer's managers when circumstances arise requiring notification of such events.
3.10. The User's participation will not be registered in the final lists until full payment is received. Participation payment is made via a non-cash transaction using the Organizer's Site and the connected payment page of the TipTop Pay processing center. If online payment is not available, cash payment is allowed by prior agreement with the BLAZE FEST Manager (customer service department).
4. RIGHTS AND OBLIGATIONS OF THE ORGANIZER4.1. The Organizer undertakes to:
4.1.1. Register participants for the BLAZE FEST event according to User requests made through applications on the Site.
4.1.2. Provide consultation to Users regarding participation in the event via phone, chat, social networks, messengers, and/or email.
4.1.3. Provide services to the Participant properly and with a quality that meets all the requirements of this Offer.
4.1.4. Provide the Participant with complete, accurate, and comprehensive information about the event by posting such information on the Organizer’s website or on the Instagram account @blaze.fest.
4.1.5. Notify Participants of any event cancellation/postponement in a timely manner using one or more available communication channels. If the Organizer fulfills all conditions but the Participant does not receive/see the message (e.g., changes phone number, does not use messengers, email, or social media), responsibility for not attending the event rests fully with the Participant.
4.1.6. Not transfer the personal data provided by the Participant to third parties. It is not a violation if the Operator provides information to its employees and other individuals involved in fulfilling obligations to the Participant as per clause 3.7 of this Offer. It is also not a violation if such information is provided to government authorities in accordance with the laws of the Republic of Kazakhstan.
4.2. The Organizer has the right to:
4.2.1. Require the Participant to comply with and fulfill the conditions of this Offer.
4.2.2. Refuse to provide services, notifying the User without explanation.
4.2.3. Cancel the registration if the payment is not made by the Participant within the designated time frame for the event or its special tariff.
4.2.4. Send informational and promotional emails and SMS messages to the Purchaser’s email address, messenger, and mobile phone.
4.2.5. Set limitations on Participant registration via the Site for one or more event categories at the Organizer’s discretion.
4.2.6. Modify the terms of this Offer unilaterally at any time, ensuring that the updated terms are published on the Site.
4.2.7. In the case of installment payment for participation in Master Classes, the Organizer may charge the Participant a commission for processing the installment request. The commission for processing the installment is 7% of the total amount of the nominal fee and service charge.
5. RIGHTS AND OBLIGATIONS OF THE USER/PARTICIPANT5.1. The User has the right to:
5.1.1. Receive confirmation of participation registration (including, but not limited to, SMS, message via email or messenger).
5.1.2. Receive complete and accurate information about the event and the conditions of attendance.
5.2. The User is obliged to:
5.2.1. Be solely responsible for the accuracy of their personal data and for the safekeeping of the receipt/invoice they receive.
5.2.2. Independently monitor updates regarding the event on the Organizer’s website and on the Instagram account @blaze.fest.
6. TERMS OF TICKET REFUND6.1. Refunds for participation in any of the sections of the BLAZE FEST event are not possible. Exceptions include reasons such as: the event being canceled by the Organizer, critical rescheduling of the event, or replacement of more than 50% of the announced judging panel. In these cases, the refund process is regulated by the following rules:
6.2. To request a refund to a bank card, it is necessary to fill out a "Refund Request" form and send it to the email address dreamway.dc@gmail.com, as well as duplicate it in the WhatsApp chat with the Organizer's team manager at the phone number: +7 701 984 44 98.
6.3. The review period for the Request and refund begins from the moment the Company receives the Request and is calculated in working days, excluding holidays/weekends, and is 20 days.
6.4. The refund will be processed to the bank card within 21 working days (or earlier) from the day the "Refund Request" is received by the Organizer. The refund amount will be equal to the purchase amount.
6.5. For refunds or corrections of funds for operations carried out with errors, a written request must be submitted along with a copy of the identity document and receipts confirming the incorrect charge. The request should be sent to dreamway.dc@gmail.com.
7. LIMITATION OF LIABILITY7.1. The Organizer is not responsible for any losses or moral harm incurred by the Participant due to a misunderstanding or lack of understanding of the information regarding registration, attendance at the event, or the use of services under this Offer.
7.2. The Organizer is not responsible for potential risks related to ensuring the safe provision of services or for cyberattacks or breaches of the Site, including, but not limited to, Site malfunctions caused by technical reasons.
7.3. The Organizer is not responsible for the Participant’s failure to comply with the provisions of paragraph 4 of Article 36 of the Law of the Republic of Kazakhstan dated August 8, 2002, No. 345-II "On the Rights of the Child in the Republic of Kazakhstan" (as amended as of October 12, 2021), which prohibits minors from being present at entertainment establishments at night (from 10 PM to 6 AM) without their legal representatives (parents, adoptive parents, guardians, or other individuals taking care of the child). The Participant assumes full responsibility if, upon registration or admission to the event, the duration of which extends beyond local time (10:00 PM) or starts at or after 10:00 PM, the venue staff requests proof of identity of the legal representative and the child’s birth certificate. If the documents are incorrect or missing, the venue management has the right to refuse ticket sales to the minor or deny entry to the event. In such a case, the Organizer does not cancel the tickets purchased by the Participant. Refunds for participation will not be made.
8. FORCE MAJEURE8.1. The Parties are released from responsibility for failure to perform or improper performance of their obligations under the Agreement during the period of force majeure. Force majeure refers to extraordinary and insurmountable circumstances that prevent the Parties from fulfilling their obligations under this Agreement. These include natural disasters, nuclear explosions, radiation (ionizing radiation), or radioactive contamination from nuclear weapons, industrial or scientific research, or radioactive waste; wars, military invasions, hostile actions by foreign enemies, military operations, military maneuvers, and related military activities; civil war, armed rebellion, civil unrest, mass riots, violent seizure or retention of power; epidemics, epizootics, meteorological conditions, terrorist acts, strikes, confiscations, requisitions, nationalization, etc. The Party affected by the above circumstances must notify the other Party as soon as possible. Publicly known events do not require confirmation, but for other events, supporting documents should be provided, which may include, but are not limited to, documents from competent state authorities.
9. OTHER CONDITIONS9.1. The Agreement enters into force from the date the User confirms their consent to the terms of this Public Offer when making a payment for participation in the event, thereby joining the Agreement.
9.2. For all matters not covered by the Agreement, the Parties are governed by the current legislation of the Republic of Kazakhstan.
